Terms and Conditions
Rules governing access to and use of the ResQAgents platform.

These Terms and Conditions, referred to as the “Terms,” govern your access to and use of ResQAgents.com and the websites, portals, forms, applications, accounts, technology, lead-generation services, and related features operated by ResQAgents LLC, doing business as ResQAgents.
In these Terms, “ResQAgents,” “we,” “us,” and “our” refer to the operating company. “You” and “user” refer to any individual or business accessing or using the Services.
By accessing or using the Services, creating an account, submitting an insurance request, purchasing a lead, or clicking to accept these Terms, you agree to be bound by them.
Do not use the Services if you do not agree.
1. Eligibility
You must be at least 18 years old and legally capable of entering into a binding agreement to use the Services.
If you use the Services on behalf of a company, insurance agency, or other organization, you represent that:
- You are authorized to bind that organization;
- The information you provide is accurate; and
- The organization agrees to these Terms.
The Services are intended primarily for users located in the United States.
2. Description of the Services
ResQAgents operates a technology and marketing platform intended to connect:
- Consumers interested in home or auto insurance; and
- Participating insurance agencies, carriers, brokers, producers, and other authorized insurance professionals.
The Services may include:
- Consumer insurance-request forms;
- Quote-matching and referral services;
- Consumer and agency accounts;
- Agency lead marketplaces;
- Lead purchasing and delivery;
- Lead-management tools;
- Reporting and performance information;
- Communication services;
- Customer support; and
- Other features introduced from time to time.
We may modify, suspend, replace, or discontinue any part of the Services.
3. ResQAgents Is Not an Insurance Carrier
Unless expressly stated otherwise, ResQAgents is not an insurance carrier and does not itself:
- Underwrite insurance;
- Determine final eligibility;
- Provide binding insurance quotes;
- Issue insurance policies;
- Bind coverage;
- Collect insurance premiums on behalf of a carrier;
- Adjust claims;
- Guarantee policy approval; or
- Make final coverage determinations.
Insurance products are offered and administered by participating insurance carriers, agencies, brokers, or licensed insurance professionals.
Only the applicable carrier or authorized insurance professional can confirm coverage, premium, eligibility, effective dates, exclusions, and policy terms.
4. No Insurance, Legal, or Financial Advice
Website content is provided for general informational purposes.
Nothing on the Services constitutes personalized insurance, legal, financial, tax, credit, or risk-management advice.
You are responsible for reviewing coverage options and consulting qualified professionals before making decisions.
5. No Guarantee of Quotes, Coverage, Savings, or Results
We do not guarantee that:
- A consumer will receive a quote;
- A consumer will qualify for insurance;
- A particular carrier will be available;
- A displayed rate will apply;
- A consumer will save money;
- An agency will contact a consumer;
- A consumer will respond to an agency;
- A lead will result in a quote or sale;
- A lead will satisfy an agency's underwriting requirements;
- A particular number of leads will be available; or
- An agency will achieve a particular return on investment.
Estimated premiums, savings claims, carrier examples, and rate comparisons are informational only unless confirmed directly by the applicable insurance professional or carrier.
6. Consumer Insurance Requests
When submitting a home or auto insurance request, you agree to:
- Provide accurate and current information;
- Submit information only for yourself or a person who has authorized you;
- Review the applicable disclosures;
- Avoid impersonating another person;
- Avoid submitting fraudulent, fabricated, or misleading information; and
- Promptly correct material errors when possible.
Submitting a request does not create an insurance contract or guarantee coverage.
Do not cancel an existing policy until replacement coverage has been confirmed by the applicable carrier or agency.
7. Communication Consent
When you affirmatively agree to a communication disclosure, you authorize the parties identified in that disclosure to contact you using the methods described.
Depending on your consent, communications may include calls, emails, and text messages concerning insurance quotes and related offers.
Communications may use automatic dialing technology, prerecorded or artificial voice technology, or automated text-message systems where legally permitted and disclosed.
Consent to marketing communications is not a condition of purchasing insurance.
Message and data rates may apply.
You may withdraw consent by:
- Replying STOP to an applicable text message;
- Using an email unsubscribe link;
- Asking a caller to place you on its internal do-not-call list; or
- Contacting info@resqagents.com.
Participating agencies and independent third parties may maintain separate records and preferences. You may need to contact them directly.
8. User Accounts
Some Services require an account.
You agree to:
- Provide accurate registration information;
- Keep account information updated;
- Maintain the confidentiality of your password;
- Use appropriate security controls;
- Prevent unauthorized account access; and
- Notify us promptly of suspected unauthorized use.
You are responsible for activity conducted through your account unless prohibited by law.
We may require password changes, identity verification, multi-factor authentication, or other security measures.
9. Agency Eligibility and Verification
Agency features are intended only for legitimate insurance businesses and authorized users.
Agency users represent and warrant that:
- They hold all licenses, appointments, registrations, and authorizations required for their activities;
- They will operate only in jurisdictions where they are legally permitted;
- Their agency and licensing information is accurate;
- Their advertising and communication practices comply with law;
- They will maintain required records and policies; and
- They will promptly notify ResQAgents of a suspension, expiration, revocation, or material licensing change.
We may request evidence of licensing, identity, business registration, authority, or compliance at any time.
Approval of an agency account does not constitute legal advice or confirmation of compliance.
10. Agency Use of Lead Information
Agency users may use consumer lead information only for the legitimate insurance purpose associated with the lead and as permitted by:
- These Terms;
- The agency agreement;
- The lead description;
- The consumer's consent;
- The Privacy Policy; and
- Applicable law.
Unless expressly authorized in writing, agency users may not:
- Resell lead information;
- Transfer lead information to unrelated parties;
- Publish consumer information;
- Use lead information for unrelated marketing;
- Create unauthorized consumer profiles;
- Use information for unlawful discrimination;
- Contact consumers outside the scope of their consent;
- Retain information longer than legally or operationally necessary;
- Circumvent platform controls; or
- Use information in violation of privacy or insurance laws.
Agency users are independently responsible for their handling of consumer information after receiving it.
11. Lead Categories and Exclusivity
Lead characteristics may vary.
A lead may be:
- Exclusive;
- Shared;
- Live-transfer;
- Real-time;
- Aged;
- Recycled;
- Location-specific;
- Product-specific; or
- Subject to other conditions described in the Agency Portal.
The applicable lead description or agency agreement controls.
The word "exclusive" does not necessarily mean the consumer has not independently contacted another insurance provider.
12. Lead Accuracy and Consumer Behavior
Lead information is generally based on information submitted by consumers or obtained through authorized sources.
We may use verification and fraud-prevention processes, but we do not guarantee that:
- Every field is accurate;
- Every telephone number or email is valid;
- Every consumer will respond;
- Every consumer remains interested;
- Every consumer qualifies;
- Every request was submitted without error; or
- Every lead will convert.
Agencies are responsible for independently verifying information before relying on it.
13. Pricing and Payment
Agency users agree to pay all fees associated with their selected services, lead purchases, subscriptions, deposits, or account activity.
Prices may vary based on:
- Lead type;
- Insurance category;
- Geography;
- Exclusivity;
- Delivery method;
- Consumer demand;
- Account level;
- Promotions; and
- Other factors displayed at purchase.
Unless otherwise stated:
- Fees are shown before purchase;
- Payments are processed using the selected payment method;
- Applicable taxes may be added;
- Users authorize applicable charges;
- Users must maintain valid billing information; and
- Unpaid amounts may result in account restriction or suspension.
Additional pricing terms may appear in the Agency Portal or a separate written agreement.
14. Lead Credits, Replacements, and Refunds
Eligibility for a credit, replacement, or refund is determined by the policy displayed in the Agency Portal or the applicable agency agreement.
A request may require:
- Submission within a specified period;
- Selection of a qualifying reason;
- Supporting evidence;
- Reasonable contact attempts; and
- Compliance with account requirements.
The following circumstances do not automatically qualify for a credit:
- The consumer did not purchase insurance;
- The consumer selected another agency;
- The consumer did not answer immediately;
- The quoted premium was not competitive;
- The consumer did not meet a carrier's underwriting requirements;
- The agency contacted the consumer too late; or
- The agency's sales process was unsuccessful.
15. Automatic Renewals and Subscriptions
Where a paid service renews automatically, the renewal terms, billing frequency, price, cancellation method, and applicable notice will be displayed before enrollment.
By enrolling, you authorize recurring charges until cancellation.
Cancellation applies prospectively and does not ordinarily reverse charges already incurred unless required by law or expressly stated in the applicable plan.
16. Prohibited Conduct
You may not:
- Violate any law or regulation;
- Submit false insurance requests;
- Impersonate another person or company;
- Access another user's account;
- Bypass authentication or security measures;
- Scrape or harvest consumer information;
- Use automated systems without written permission;
- Introduce malware or harmful code;
- Interfere with platform operation;
- Test system vulnerabilities without authorization;
- Use the Services for spam or unlawful telemarketing;
- Resell platform access;
- Misrepresent affiliation with ResQAgents;
- Infringe intellectual-property rights;
- Use consumer data for unlawful discrimination;
- Reverse engineer protected platform technology; or
- Assist another party in prohibited conduct.
17. Compliance With Laws
Users are responsible for complying with all laws applicable to their activities.
Agency users are particularly responsible for laws and regulations concerning:
- Insurance licensing;
- Producer appointments;
- Advertising;
- Unfair or deceptive practices;
- Privacy and data security;
- Telephone and text-message communications;
- Email marketing;
- Do-not-call requirements;
- Call recording;
- Consumer consent;
- Data retention;
- Anti-discrimination;
- Recordkeeping; and
- Insurance sales and solicitation.
ResQAgents does not provide legal compliance advice to agency users.
18. Intellectual Property
The Services and their content, including trademarks, logos, designs, software, text, graphics, databases, page layouts, and platform features, are owned by ResQAgents or its licensors and are protected by applicable intellectual-property laws.
We grant you a limited, revocable, non-exclusive, non-transferable right to use the Services for their intended purpose.
No ownership rights are transferred to you.
19. User Content and Feedback
If you submit reviews, feedback, suggestions, or other content, you represent that:
- You have the right to provide it;
- It is accurate to the best of your knowledge;
- It does not violate another person's rights; and
- It is not unlawful, fraudulent, threatening, or defamatory.
You grant ResQAgents a non-exclusive, worldwide, royalty-free right to use feedback to improve and promote the Services, subject to applicable privacy obligations.
20. Third-Party Services
The Services may contain links to or integrations with insurance agencies, carriers, payment processors, analytics providers, communication platforms, and other third parties.
Third-party services are governed by their own contracts and privacy policies.
We are not responsible for independent third-party services, content, decisions, coverage determinations, or business practices.
21. Privacy
Our collection and use of personal information are described in the Privacy Policy.
The Privacy Policy is incorporated into these Terms by reference.
Agency users may have separate legal obligations concerning personal information received through the Services.
22. Electronic Communications
You consent to receive agreements, notices, disclosures, invoices, and other records electronically.
You agree that electronic records satisfy legal requirements that communications be in writing, subject to applicable law.
You are responsible for maintaining a working email address and compatible device.
23. Suspension and Termination
We may restrict, suspend, or terminate access when we reasonably believe that:
- A user violated these Terms;
- An account presents a security or fraud risk;
- Payment is overdue;
- Agency licensing cannot be verified;
- A user misused consumer information;
- Continued access creates legal or operational risk; or
- Suspension is required by law or a government request.
You may stop using the Services at any time.
Termination does not eliminate obligations incurred before termination, including payment, confidentiality, data protection, indemnification, or dispute obligations.
24. Disclaimer of Warranties
TO THE MAXIMUM EXTENT PERMITTED BY LAW, THE SERVICES ARE PROVIDED "AS IS" AND "AS AVAILABLE."
RESQAGENTS DISCLAIMS EXPRESS AND IMPLIED WARRANTIES, INCLUDING WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, NON-INFRINGEMENT, ACCURACY, AVAILABILITY, AND RESULTS.
WE DO NOT WARRANT THAT THE SERVICES WILL BE UNINTERRUPTED, ERROR-FREE, COMPLETELY SECURE, OR FREE FROM HARMFUL COMPONENTS.
Some jurisdictions do not permit certain warranty exclusions. In those jurisdictions, the exclusions apply only to the extent legally permitted.
25. Limitation of Liability
TO THE MAXIMUM EXTENT PERMITTED BY LAW, RESQAGENTS AND ITS OWNERS, OFFICERS, EMPLOYEES, AFFILIATES, CONTRACTORS, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, EXEMPLARY, OR PUNITIVE DAMAGES, OR FOR LOST PROFITS, LOST REVENUE, LOST DATA, LOST BUSINESS, OR LOSS OF GOODWILL.
TO THE MAXIMUM EXTENT PERMITTED BY LAW, OUR TOTAL LIABILITY ARISING FROM THE SERVICES WILL NOT EXCEED THE GREATER OF:
- THE AMOUNT YOU PAID DIRECTLY TO RESQAGENTS DURING THE SIX MONTHS BEFORE THE EVENT GIVING RISE TO THE CLAIM; OR
- ONE HUNDRED U.S. DOLLARS.
This limitation does not apply where liability cannot legally be limited.
26. Indemnification
To the extent permitted by law, business and agency users agree to defend, indemnify, and hold harmless ResQAgents and its affiliates, owners, officers, employees, and service providers from claims, damages, losses, liabilities, costs, and expenses arising from:
- Their use of the Services;
- Their violation of these Terms;
- Their insurance, marketing, or communication activities;
- Their handling of consumer information;
- Their violation of law;
- Their infringement of another party's rights; or
- Their negligence, fraud, or willful misconduct.
27. Governing Law and Venue
These Terms are governed by the laws of the State of California, without regard to conflict-of-law principles.
Subject to any legally required consumer rights, disputes must be brought in the appropriate state or federal courts located in California, and the parties consent to those courts' jurisdiction.
28. Changes to These Terms
We may update these Terms to reflect changes in the Services, business practices, or legal requirements.
Updated Terms will be posted with a revised "Last Updated" date.
When legally required, we will provide additional notice or request renewed acceptance.
Continued use after an update becomes effective constitutes acceptance to the extent permitted by law.
29. General Terms
If a provision of these Terms is found unenforceable, the remaining provisions remain in effect.
Our failure to enforce a provision is not a waiver.
You may not assign your rights or obligations without our written consent. We may assign these Terms as part of a merger, acquisition, restructuring, sale of assets, or similar transaction.
These Terms, the Privacy Policy, applicable portal policies, and any signed agency agreement form the entire agreement concerning the Services.
